The protection of personal data is a matter of trust and we want to give you the certainty that your data is in our hands. Therefore, the terms “we”,  or “MAREMASK” hereinafter refer to MAREMOD S.A., as the operator of the MAREMASK Online Store.

2. WHAT DATA DOES MAREMASK COLLECT?

2.1 When you visit our website
You can visit the MAREMASK Online Store without providing data about yourself. In this case, we record the technical access data that your browser automatically sends to our server, as a result of accessing the website. The access data shall include in particular the following information:

  • Date and time of access
  • The address of the accessed website and the website where the access is made
    Content of the request (addresses and file names requested)
  • Information about the browser used and the operating system (versions, language settings)
  • Online identifiers (for example: IP address, device identifiers, session IDs)
  • If applicable, error messages (if the requested content cannot be displayed)
  • The web page you visited previously, starting from which you accessed, through a link, a page of the MAREMASK Online Store

Your access data will be automatically stored during your visit, in the server log files (Server-Logfiles) on our server and then anonymized by shortening or deleting your IP address. Direct identification of your person based on server log files (Server-Logfiles) will no longer be possible.

In addition, during your visit to the Online MAREMASK Store, we only record those data that you actively communicate to us using the functions provided for this purpose. For example, we find out what products you are interested in when you save an item to your favorites list or use the search function.

2.2 Cookies

2.3 When registering for a customer account
Of course you can shop in the MAREMASK Online Store as a visitor, without having a MAREMASK customer account. However, registering in our online store can facilitate your future shopping in our store and can give you a more personalized and easier shopping experience. For example, on the next order, the address data, the payment methods, as well as the transport service provider will be preselected. With the help of the customer account we can store your data (such as order information and the content of your wish lists, as well as the products you have viewed), in an integrated way in our database and, based on them, let you we offer personalized product recommendations and more relevant search results, depending on your interests in previous purchases.

If you register for a MAREMASK customer account, we provide you with direct, password-protected access to your customer data stored by us (for example, MAREMASK customer number, name, address, date of birth, telephone number, email address -mail, payment details), order information (products ordered, item numbers, size data) and other information (eg products from the list of preferences). The mandatory information required for registration is usually specially marked, e.g. with an asterisk (“*”). In the case of data provided voluntarily, we indicate the reason for which we request them. In addition, for security reasons, we are temporarily storing your IP address used for registration.

You can always delete your MAREMASK customer account and the data stored in it. In this regard you can send us a simple informal message, for example, by e-mail, to contact@maremask.com or use

2.4 When you order something at the MAREMASK Online Store
We record which products you order or save in the list of preferences. In addition, we store data that is directly related to the execution of your orders. Order data shall include in particular:

  • Information on the products ordered, such as item numbers and size
  • Email Address
  • Billing and delivery address
  • Payment details
  • Payment behavior information and creditworthiness information we may receive from credit reporting agencies about you.
  • Details of returns and complaints (e.g., reasons for return, notification of defects)
  • Order numbers
  • Tracking numbers of shipment orders by shipping service providers (eg DHL International)

Even if you place multiple orders as a visitor and use identical customer data for each order, our systems place the data in a single customer database to facilitate the maintenance of our customer database. If you subsequently register with this customer data for a MAREMASK customer account, we may connect the unique customer database to your customer account so that you can access your previous orders as well.

2.5 When you contact us
When you contact us through the contact form on our website, by e-mail, telephone or in any other way, we will collect the related communication data. Depending on the channel you contact us, they will include, for example, your contact details (such as your email address or phone number) and the content of your message to us. Phone calls to MAREMASK customer service will only be recorded if you have expressly agreed to this (for example, for training or quality purposes).

We also use the offers of social networks such as Facebook, Instagram to keep in touch with our customers. Please note that MAREMASK has no influence on the conditions of use of social networks and their data processing practices. For this reason, please carefully check the personal information you transmit through social networks.

3. FOR WHAT PURPOSE DOES MAREMASK USE MY DATA?

3.1 Preparing MAREMASK Online Stores
When you visit the web pages of the MAREMASK Online Store, we process the related access data, server log files (Server-Logfiles) and cookies to provide you with our web page and the content and functions you have requested, such as and to ensure the stability and security of our IT systems and databases.

3.2 Fulfillment of the contract, in particular the conduct of purchases
We process your data in order to perform the contracts concluded with you and to provide services, as a result of your wish. The goals are oriented primarily according to the concrete content of the contract, respectively according to the object of the services requested by you. Details of the purposes of processing may be found in the respective contractual documents and in the contractual terms and conditions, such as, for example, the General Contractual Terms and Conditions.   • Execution of purchase contracts
  • Making raffles and actions

3.3 Customer service and communication in existing customer relationships
We process your data for customer service. This includes, for example:

  • Processing your concerns and requests through MAREMASK customer service
  • Non-advertising communication with you (eg safety instructions and technical assistance)

3.4 Execution of payments
Depending on the agreed payment method, we pass on the data needed to process payments (for example, direct debit or credit card data) to the payment service provider responsible for payment. Payment service providers collect this data, in part, at their own risk. In this case, the data protection instructions of that payment service provider will apply.

The transmission of your data to external payment service providers is based on Article 6 para. (1) letter (b) of the GDPR (performance of the contract).

If you choose to pay by credit card at check-out, the issuing company will perform a two-step risk / authentication check.

As a first step, the following data will be transmitted to the credit card company:

  • your name (address form, first name, last name)
  • your address
  • delivery address, if different from your address (including Click & Collect and parcel stations)
  • Your email address.

If the transmitted data shows deviations that could indicate an increased risk, a second verification step takes place, which also requires an interaction with the cardholder (requesting a second factor, such as entering a password or PIN) .

4. WEB ANALYSIS

4.1 GOOGLE ANALYTICS
Our site uses the Google Analytics web analytics service provided by Google LLC, 1600 Amphitheater Parkway, Mountain View, CA 94043, USA (“Google”). Google Analytics uses cookies valid for 14 months to record your login information when you visit our website. Access data is aggregated by Google on our behalf into pseudonymous usage profiles and is transmitted to a Google server in the United States. Your IP address is first anonymized. Therefore, we cannot determine which user profiles belong to a particular user. Thus, based on the data collected by Google, we are unable to identify you or determine how you use our website. If, exceptionally, certain personal data is transferred to the US, Google complies with the EU-US Privacy Shield. Google has thus undertaken to comply with European principles on the protection of personal data and the high level of data protection, including in the context of data processing in the US.

Google will use the information obtained through cookies on our behalf to evaluate the use of our site, compile reports on website activity and provide us with other services related to our use of the website and the Internet. You have the right at any time to object to a web analysis by Google. In this sense, you have several possibilities:

The legal basis of this data processing is represented by article 6 par. (1) letter a of the GDPR (your consent).

5. ONLINE ADVERTISING

We use in connection with the MAREMASK Online Store various partner advertising networks, in order to be able to display your advertising according to your interests and on external sites. To this end, we have integrated various technologies into our MAREMASK online store, which make recognition possible (for example, through a cookie set set when visiting the store and later recognized). By this we do not transmit at any time data to our partners, based on which you could be directly identified. Thus, the partners do not receive names or contact details, but only certain identifiers that make it possible to re-address. This allows our partners to run advertising that, based on our evaluation, serves your interests. Therefore, on the websites of the partner networks it will be possible to display advertisements for products or categories of products that you were previously interested in in our store or that we think might be of interest to you.

The legal basis of this data processing is represented by article 6 par. (1) letter a of the GDPR (your consent).

You have the option to prevent the storage of third-party cookies that are used to implement the data processing described below by setting your browser accordingly (as explained in section 2.2). The following descriptions also include other possibilities for exercising the right of opposition. Please note that it is possible to collaborate in certain circumstances and temporarily with partners not listed below.

5.1 FACEBOOK
Our websites use for marketing purposes the so-called conversion and retargeting tags (also known as “Facebook Pixel”) of the social network Facebook, a service provided by Facebook Inc., 1601 Willow Road, Menlo Park , California 94025, USA (“Facebook”). We use Facebook Pixel to analyze the overall use of our websites and to monitor the effectiveness of Facebook advertising (“Conversion”). In addition, we use Facebook Pixel to run personalized advertising messages based on your interest in our products (“Retargeting”). Facebook processes data that the service collects through cookies and similar technologies on our sites.

The resulting data in this context may be transmitted by Facebook for evaluation purposes to a server in the United States, where it is to be stored. If personal data is transferred to the US, Facebook respects the EU-US Privacy Shield.

5.2 GOOGLE ADWORDS AND ADWORDS REMARKETING
Our website uses AdWords Conversion-Tracking and AdWords Remarketing services provided by Google LLC, 1600 Amphitheater Parkway, Mountain View, CA 94043, USA (“Google”). AdWords Conversion-Tracking services capture and analyze customer actions that we define (such as ad clicks, pageviews, downloads) are captured and analyzed. We use AdWords Remarketing to show you personalized advertising for our products on Google’s partner sites. Both services use cookies and similar technologies. The data collected in this context may be transmitted by Google for evaluation purposes to a server in the United States, where it is to be stored. If personal data is transferred to the US, Google respects the EU-US Privacy Shield.

If you use a Google Account, depending on the settings stored in your Google Account, Google may associate your web browsing history and applications with your Google Account and may use the information in your Google Account to personalize your advertising. If you do not want such a connection to your Google Account, you will need to log out of Google before visiting our website.

You can disable the processing of your data for personalized online advertising at any time through the Google Ad Network. There are several ways to do this:

6. TO WHOM IS MY DATA SUBMITTED LATER?

In principle, we pass on your personal data only when:

  • you have expressly agreed in accordance with Article 6 para. 1 letter a of the GDPR
  • in accordance with Article 6 para. (1) Subparagraph (f) of the GDPR is necessary for the validation, exercise or defense of legal rights and there is no reason to assume that you have a legitimate interest in opposing the transmission of your data,
  • we have a legal obligation to transmit data, in accordance with Article 6 para. 1 letter c or e of the GDPR, in particular where there is an obligation to disclose to an authority, or
  • transmission is legally permitted and required in accordance with Article 6 para. (1) letter b of the GDPR, for the purpose of carrying out contractual relations with you or for initiating pre-contractual measures, at your request.

Part of the data processing procedure described in this personal data protection policy may be performed on our behalf by external service providers. In addition to the service providers mentioned in this personal data protection policy may include, in particular, data centers that maintain our website and store our databases, IT service providers that maintain the systems and consulting firms.

If we transfer data to our service providers, they may use the data solely for the purpose of providing those services. The processing of your data by the designated service providers takes place during the processing of orders in accordance with Article 28 GDPR. Service providers are carefully selected and designated by us. They are contractually bound by our instructions, have adequate technical and organizational measures in place to protect the rights of data subjects and are regularly monitored by us.

7. HOW LONG WILL MY DATA BE STORED?

Unless otherwise provided in this personal data protection policy, we will only store your data for as long as is necessary to fulfill our contractual or legal obligations or the purposes for which the data was originally collected, respectively we have a legitimate interest in their subsequent storage.

In all other cases, we will delete your personal data, except for any data that we must keep during the legal data storage periods. However, in such cases, we take measures to limit the processing, more precisely, your data will be used exclusively for the purpose of legal compliance.

If you delete or cancel your MAREMASK customer account, we will delete all data stored there about you. If, for legal reasons, the complete deletion of your data is not possible or necessary, that data will be limited from further processing. As a rule, your order and payment data and, where applicable, other data, are subject to legal storage requirements, such as, for example, within the meaning of the Commercial Code and the Tax Code. Therefore, we are obliged to keep this data for a period of up to ten years.

Even if your personal data is not subject to any legal obligation to store, we may not consider deleting it in legally permitted cases and may block it instead. This provision applies in particular in cases where we may still need those data for the subsequent performance of the contract, for a legal action or an action in defense. For the duration of such a blockade, the legal limitation periods will be taken into account.

8. YOUR RIGHTS REGARDING THE PROTECTION OF PERSONAL DATA

To protect your legal rights regarding the protection of your data described below, you can contact our data protection officer at any time (see section 1):

You have the right to request information at any time regarding the processing of your personal data by us. As part of the provision of information, we will explain the data processing procedure and provide you with a summary of your personal data that we have stored.

If your personal data that we have stored is incorrect or out of date, you have the right to request its rectification.

You can also request the deletion of your data. If, for exceptional reasons, it is not possible to delete this data in accordance with other legal provisions, the data will be blocked so that they are only available for this legal purpose.

If you wish to exercise the legal right of revocation and opposition mentioned below, it is sufficient to send an informal notification to the contact details mentioned in section 1 above.

Revocation of consent

In accordance with Article 7 para. (2) of the GDPR, you have the right to revoke at any time the consent you have given us. This has the consequence that we no longer continue to process your personal data based on this consent. Revocation of your consent does not affect the lawfulness of the processing carried out on the basis of your consent until the date of revocation.

The right to object to the processing of your personal data

To the extent that we process your data on the basis of legitimate interests, in accordance with Article 6 para. (1) (f) of the GDPR, you have the right to object to the processing of data in accordance with Article 21 of the GDPR, insofar as there are reasons related to your special situation or your opposition relates to direct advertising. In the latter case, you have a general right of opposition which will be exercised by us without specifying the reasons

10. SECURITY OF PERSONAL DATA

We implement appropriate technical measures to ensure the security of your personal data, in particular to protect your data from any danger in the event of its transmission as well as from unauthorized access by third parties. They will be adapted according to the current state of technology. For the security of personal data provided by you on our website, we use Transport Layer Security (TLS), which encrypts the information you provide to us.

11. AMENDMENTS TO THIS PERSONAL DATA PROTECTION POLICY

We occasionally update this personal data protection policy, for example when we update our website or in the event of changes in legal or regulatory requirements. Any significant changes will be documented in this personal data protection policy and, if necessary, we will consent to our customers.
